1.1 AfAA is committed to protecting and respecting your personal information.

1.2 This policy sets out the basis on which your personal information is collected by us, will be processed by us, and also sets out your rights in relation to that information.

1.3 AfAA is the data controller in respect of personal information provided to us.

2 HOW WE COLLECT INFORMATION FROM YOU

2.1 We will collect and process information about you when you submit your profile to be included in the Directory.

3 INFORMATION WE MAY COLLECT FROM YOU

3.1 The personal information that we process may include:

(a) basic information, such as your name (including name prefix or title), the company you work or and your title or position;

(b) contact information, such as your postal address(es), email address(es) and phone number(s);

(c) financial information, such as payment-related information for the Directory;

(d) technical information, such as information materials and communications we send to you electronically;

(e) information you provide to us for the purposes of being listed in the Directory;

(f) identification and background information provided by you or collected as part of our registration process for the Directory;

(g) any other personal information provided to us for purposes of the Directory.

5 HOW WE USE THIS INFORMATION

5.1 We might use information held about you in the following ways:

(a) In the provision of our services to you or to others;

(b) to notify you about changes to our services;

(c) to promote our services, including sending newsletters and details of events; and

(d) to provide and improve our Directory, including auditing and monitoring its use

6 HOW LONG WE KEEP YOUR INFORMATION

6.1 Your personal information will only be retained for as long as you are listed in the Directory. Retention periods vary depending on the category of data.  For instance, if you wish to delete your listing in the Directory, we will delete your data.

7 DISCLOSURE OF YOUR INFORMATION

7.1 Your information will not be disclosed to third parties outside of AfAA, except to those who use the Directory in search of an arbitrator

8 SHARING YOUR E-MAIL ADDRESS AND PHONE NUMBER

8.1 We will share the e-mail address and phone number provided when you submitted your profile for inclusion in the Directory, with users of the Directory for them to be able to contact you should they wish to appoint you as an arbitrator.  By submitting your personal data, you expressly agree to this. We will take all steps reasonably necessary to ensure that your personal data is treated securely and in accordance with this privacy policy.

8.2 Payments made in connection with our online registration system will be processed via a third party payment service provider. Please see the separate terms and conditions of that provider for further terms (including relating to your personal data provided to that provider) that may apply to you for use of that third party payment service.

8.3 We implement commercially reasonable security measures to help protect against unauthorised access to or unauthorised alteration, disclosure, or destruction of data.  Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site including via our online submission forms; any transmission is at your own risk. Once we have received your personal data, we will use strict procedures and security features to try to prevent unauthorised access.

9 YOUR RIGHTS

9.1 The European Union’s General Data Protection Regulation and other applicable data protection laws provide certain rights for data subjects.

9.2 These rights include the right to access, amend or delete your personal information or, in some circumstances, to restrict or object to the processing or your personal information.

9.3 You may also have the right to submit a complaint to the relevant supervisory authority in your jurisdiction.

9.4 If you would like to request a copy of your data, or would like to take steps to exercise your rights please contact us as set out below.

9.5 If the relevant legislation allows us to do so, we may refuse to provide access or may charge a fee for access, in which case we will provide reasons for our decision as required by law.
